“The whole duty of the government is to prevent crime and preserve contracts.’Lord Melbourne
Contracts form the basis of most business relationships. Contract management might sound scary, but just as with our basic bookkeeping workshop, you already know the basics, you just use different terms. If you rent a house or a flat, you sign a contract with the owner. In it are what is expected of you as a tenant and what is expected of the owner as a landlord.

Marriage is sometimes accompanied with a prenuptial contract, mostly specifying ownership and debt. As you can see, it’s nothing mysterious; we are simply going to change the definition of words and the terms to a business capacity.
What is contract management? As we teach in the Contract management Course, It is more than merely drawing up a contract; a contract manager ensures the entire process runs smoothly. The contract manager is involved from the conception through to the execution of the project and even the renewal stage. We will learn about the different types of contracts and the risks involved with poor contract management.
The following two modules of the Contract management Course are devoted to contract law and what the businessman and the contract manager need to know about contract law. At boti.co.za we have specifically made this applicable to South African law and thus relevant. Breach of contract is also dealt with here.
Our Contract management Course continues with contract management requests, choosing bidders for a tender, request for production or information and how the contract manager eventually chooses the company who wins the bid or tender. We follow this with a glance at how to create a contract, software, compliance and complete the module with a look at risks of non compliance.

TIP: Contract Negotiation:
- Be prepared, so that you know what you want to negotiate about and what you need only clarify.
- Prioritize points on the agenda which you want to negotiate first.
- Remain professional and watch your tone and body language, be willing to compromise.
- Remember to present facts over feelings and know when to walk out of a negotiation meeting.
Now that we have a contract in place, we must learn how to assess the performance of the contract in execution, we will learn what can be assessed, how to create metrics, how to measure performance and how to improve performance.
Before we end off the Contract management Course we will discuss the issues surrounding an effective relationship between the contract manager and the production company. We will also look at amending contracts and including and excluding clauses. In our final module we learn about auditing the production process or auditing the contract in execution. If it sounds complicated, it isn’t, it is the equivalent of you hiring a builder to build a wall around your property, while the wall is being built, you examine it and make sure you’re getting what you paid for, and you are auditing the builder. Nothing difficult to understand.
